The Website is operated by Cobalt Axis LLC, doing business as CARB Certification ("CARB Certification," "we," "us," or "our"), and these Terms are an agreement between you and Cobalt Axis LLC.

By accessing or using this Website and our services, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions at all times.

If you do not agree with these Terms and Conditions, you should not use this Website or our services.

2. Eligibility

To use our services, you must be at least 18 years old and authorized to act for the vehicle owner or business whose information you submit.

3. Independent Service Provider Disclaimer

CARB Certification is a private third-party service provider.

We are not affiliated with, endorsed by, or operated by the California Air Resources Board (CARB), the California Department of Motor Vehicles (DMV), or any government agency.

Our services are limited to third-party reporting assistance for CARB compliance through the Clean Truck Check Vehicle Inspection System (CTC-VIS).

Important information:

• For Clean Truck Check reporting and compliance renewals, the $32.13 CARB compliance fee required by the state is included in our service fee.
• CARB Certification does not perform emissions testing.
• Emissions testing must be completed at CARB-authorized testing facilities.

Our role is limited to assisting with reporting and submission of compliance information.

4. Intellectual Property

All content published and made available on this Website is the property of CARB Certification and its licensors. This includes but is not limited to:

• Website design
• Text
• Logos
• Graphics
• Images
• Documents
• Downloadable files
• Software
• Layout and structure

You may not reproduce, distribute, modify, or use any content from this Website without written permission.

5. Acceptable Use

By using this Website, you agree to use it only for lawful purposes.

7. Services Provided

CARB Certification provides third-party assistance services, including but not limited to:

• Clean Truck Check reporting assistance
• CARB compliance reporting support
• CTC-VIS reporting submissions
• Registration and compliance updates

CARB Certification does not guarantee approval or compliance status, as final determinations are made by CARB and related regulatory systems.

8. Service Fees

Our service fee is $76 for the first vehicle and $69 for each additional vehicle on the same order.

For Clean Truck Check reporting and compliance renewals, this includes the $32.13 annual CARB compliance fee per vehicle, which we pay to CARB on your behalf. Other services, such as a 5-day pass or CTC-VIS account setup, do not include a CARB fee.

All fees are displayed on the Website before purchase, and the total shown at checkout is the price you pay.

We may change our prices for future orders. A price change never affects an order you have already paid for.

9. Payments

Payments are processed securely by our payment processor, Stripe. We never see or store your full card number.

The payment methods available to you are shown at checkout.

By providing payment information, you authorize CARB Certification to charge the payment method for the total amount due.

If we suspect fraudulent or unauthorized payment activity, we reserve the right to cancel the transaction.

10. Order Processing

Once an order is submitted:

• Your information will be reviewed
• The reporting process may begin
• Submission may be made to the CARB reporting system

Processing times may vary depending on system availability and the accuracy of the information provided.

11. Cancellation and Refund Policy

Orders cannot be canceled or refunded once processing has begun or the submission has been assigned to our processing team.

Refunds may only be considered in limited situations, such as:

• Duplicate orders
• Technical errors
• Payment processing mistakes

If we cannot complete the service you purchased, we will refund what you paid for it, less any CARB compliance fee we have already paid to CARB on your behalf.

Refund requests must be submitted by contacting our support team.

12. Limitation of Liability

To the maximum extent permitted by law, CARB Certification and its owners, employees, contractors, affiliates, and partners will not be liable for any damages, including but not limited to:

• Loss of business
• Loss of profits
• Regulatory penalties
• Compliance delays
• Errors resulting from incorrect information provided by the user
• Website interruptions

To the maximum extent permitted by law, our total liability for any claim relating to an order will not exceed the amount you paid us for that order.

Nothing in these Terms limits liability for fraud, willful misconduct, or anything else that cannot be limited under California law.

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXCEPT AS REQUIRED BY LAW.

13. Indemnification

You agree to indemnify and hold harmless CARB Certification, including its owners, employees, contractors, affiliates, and agents, from any claims, damages, liabilities, costs, or expenses arising from:

• Information you submit that is inaccurate or that you were not authorized to submit
• Your violation of these Terms
• Your misuse of our services

14. Third-Party Systems

Our services may interact with third-party government or regulatory systems, including the CARB Clean Truck Check Vehicle Inspection System (CTC-VIS).

We do not control these systems and are not responsible for outages, delays, or changes in government processes.

15. Consumer Protection

Nothing in these Terms limits rights you may have under applicable consumer protection laws, including California law.

Where required by law, these Terms will be interpreted in compliance with those legal protections.

16. Applicable Law

These Terms are governed by and interpreted according to the laws of the State of California, without regard to conflict of law principles.

Any lawsuit relating to these Terms or our services must be brought in the state or federal courts located in Los Angeles County, California, unless consumer protection law gives you the right to bring it elsewhere.

17. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

18. Changes to These Terms

CARB Certification may update these Terms and Conditions at any time.

Changes will be posted on this page with a new effective date and apply to orders placed after that date. An order you have already paid for is governed by the Terms in effect when you placed it.

Your continued use of the Website after updates constitutes acceptance of the revised Terms.
